Wrongful Death Claim against a Med Mal

The son of a Jackson, MS woman, who passed away while being hospitalized, is filing a wrongful death lawsuit against SJMC. The information submitted in the lawsuit, claims his mother was a victim of medical malpractice due to various medical errors and acts of medical omissions.

According to the suit, Jonathan Backers, is filing a suit alleging a failed brain surgery. The suit alleges that a medical device used in the procedure was not approved by the manufacturer. The manufacturer of the medical device specifically warned the device should only be used for certain surgical procedures.

The wrongful death claim against the defendant and surgeon alleges a series of negligent acts, including the use of a surgical device specified by its manufacturer for the use of certain procedures, and wrong surgical techniques.

According to the suit, Backer’s mother was suffering from excessive blood flow into the heart which was a result of an abnormal vein in the base of the brain.  The procedure was scheduled for about 2 hours but Mr. Backers mother passed away during the surgical process.

There is no information of how much money Mr. Backers and his attorney are suing for.

The two men, one who has been identified as Anthony Taylor from South Bend, IN, 45 years of age, died after receiving a kidney and liver transplant. Another man, whose name has not yet been released, died after receiving a kidney from the same woman.

The two families with the representation of medical mal attorneys claim the organ group did not properly screen the patient before the donation of her kidneys. Sources say, the group claims they are not at fault because the screening met both state and federal regulations.

Medical malpractice suits can take years before compensation is recovered if ever. The amount of money the families are suing for has not been disclosed at this time.
