Personal Injury Accident Collision in New York Settled
According to reports a personal injury accident in New York from a collision was settled in Appellate Court. The First Department of the New York Appellate Division allowed damages of 18.5 million to a woman who lost her leg from a bus accident; her left leg was amputated. The lawsuit, which was heard in the New York Supreme Court, resulted in a 27.5 million jury verdict last year.
The plaintiff in the lawsuit, Gloria Aguilar, was catastrophically injured when she was struck by a bus in Manhattan. The bus driver who was employed by NYC Transit Authority was found to be negligent.
The cash award is the largest ever allowed in New York for this type of personal injury.
There are thousands of personal injury accidents resulting in collisions each year in New York. In fact the vast majority of personal injury accidents in New York result in motor vehicle accidents. If you have been involved in a personal injury accident, you should contact an attorney immediately.

Personal Injury Compensation Falls While Claims Rise
Initial reports indicate a significant decrease in personal injury compensation paid out from insurance companies this past year. The amount of money paid out to victims this past year was down, even though the number of claims increased. Over a third of the claims reported were motor vehicle accidents. The number of motor vehicle accident claims is typically the largest number for all personal injury related claims.
Personal injury claims account for the majority of lawsuits filed each year. The main source paying out personal injury claims are insurance companies. Insurance companies have the reputation of being hard to negotiate with in and out of the courtroom. About 90% of the claims that are paid out on a yearly basis never reach a court room.
While personal injury claims may have increased, because Americans are out of work and living paycheck to paycheck, many are forced into smaller settlements. Insurance companies oftentimes have leverage in the negotiation process because they know the average person needs a quick settlement to pay for their bills; even if it’s not a fair settlement.
If the economy continues to struggle and people are still out of work, this number is likely to continue to spiral downward. We should have a good indication after the first quarter of this year, whether insurance companies made record breaking profits again this past year. It’s very likely based upon this report, they did.

Larger Lawsuit Cash Advances
Approving a million dollar lawsuit cash advance can be very hard for some lawsuit funding companies. The majority of approvals from major legal financing institutions range from $1,000 to $10,000. At LawLeaf we find that while many of our clients fall into the smaller loan sizes, we also have a fairly large base of clients seeking lawsuit cash advances in excess of $100,000 or more. When LawLeaf receives a 6, 7 or 8 figure lawsuit cash advance request, the request will be in great hands. LawLeaf’s reputation is based solely on our ability to provide fast services, competitive rates with the ability to provide funding with no cap.
Over the last year, LawLeaf has been involved in transactions ranging from $500,000 to $6,000,000.
How much money is your case worth?
In order to qualify for a large lawsuit cash advance you must have a good case with clear liability. We offer financing to plaintiffs that have personal injury claims and commercial litigation lawsuits. We can provide pre settlement funding and post settlement funding for all types of personal injury cases. We can also provide pre settlement and post settlement funding for most commercial & consumer cases, however, if you are requesting an amount of two million dollars or less, we prefer the case be near a settlement or a settlement or judgment has been awarded.
How long does it take to get a lawsuit cash advance?
There are several factors that determine the quickness of the advance:
Personal injury cases: We will require documentation on your case. If we receive the documentation from your attorney’s office in a timely manner, we can turnaround an advance in less than 24 hours. We just need the appropriate documentation and access to your attorney if we have questions. If the case is settled we will need the settlement offer. Settled cases generally can be funded within 24 hours.
Commercial & consumer litigation cases: We will require documentation on your case. If we receive the documentation from your attorney’s office in a timely manner, we can generally turnaround an advance in less than a week. Because of the complexity of commercial and consumer cases and the shortage of commercial & consumer underwriters, the turnaround time is generally longer than a personal injury case.
$2 million +: If you are requesting funding on a commercial or consumer case of $2 million dollars or more the process can take several weeks. We have been successful in securing lawsuit cash advances in excess of $2 million or more. We have a strict process in place that includes an interview with the client and/or attorney, preparing an executive brief overview and submitting the package out. The executive brief is an extremely important step in the process and can take several days to complete. Once the package is submitted there is a three tier process that takes place on the back-end. The initial underwriter will evaluate the case and determine whether the case is a fit. Once approved by the underwriter the file goes to the second tier where additional underwriters and managing directors will evaluate the case. If it gets approved in the second layer of the process it will go in front of a board for a final approval.
If you are considering litigation financing for a larger claim, we have the expertise in handling and getting applicants approved. For additional information on our top tier services, contact LawLeaf today.

In the News:
A Sacramento personal injury law firm of Demas & Rosenthal recently won a $2.5M verdict. The verdict is the largest personal injury verdict awarded in Tuolumne County, California to date. The case was heard in Tuolumne County Superior Court in Sonora California.
The partners of Demas & Rosenthal, John N. Demas and S. David Rosenthal, received a favorable verdict in the case of Hueso v. Diestel Turkey Ranch. Attorney John N. Demas represented the children of Mr. and Mrs. Hueso, a husband and wife who were tragically killed in an automobile accident. The auto accident occurred when their vehicle collided with a truck operated by Diestel Turkey Ranch.
During the initial investigation, the California highway Patrol found the driver the vehicle, Mr.Hueso at fault. The family of the victims took the issue further and filed a personal injury lawsuit proving Mr. Hueso was the victim of the accident and was not at fault.
The Huesos’ first attempt to a settle the case out of court was turned down by Diestel Turkey. The defense alleged they were not the negligence party and would offer nothing towards a settlement. The attorney that initially took the case for the Huesos’ decided to refer it to John N. Demas, an experienced trial attorney who represents plaintiffs throughout the state of California.
Mr. Demas was able to prove the trailer lights on the truck were not properly working and as a result an accident occurred. Mr. Demas was also able to prove that Diestel’s trucks were not maintained to industry standards and drivers were not provided the necessary safety training. As a result, the jury awarded the victim $2,500,000 for the tragic loss of the life of Mr. & Mrs. Hueso. This settlement is believed to be the largest personal injury settlement in Tuolumne County.

If you are searching for settlement funding for a lawsuit that has recently settled or currently pending, contact LawLeaf today by applying online or calling us toll free. LawLeaf is leading provider of lawsuit settlement loans provides settlement funding to plaintiffs that have the legal representation of an attorney. Settlement funding is a term that is used when describing a lawsuit cash advance against a personal injury or commercial litigation claim. We currently work with clients throughout the United States and Canada that are in dire need of money to help pay for bills while waiting for compensation.
In the News:
LawLeaf is proud to announce the development of our new settlement center. The settlement center will be dedicated to providing information and assistance to those plaintiffs that have recently reached a lawsuit settlement but can’t wait until proceeds are paid. Over the last several years, LawLeaf has seen an increase in applicants requesting post settlement funding; loans against settled lawsuits. These clients oftentimes call LawLeaf because they have an immediate financial obligation that can’t wait. While LawLeaf strives to offer the most competitive rates for pre settlement funding, post settlement funding typically offers lower rates than advances against pending lawsuits. The reason is risk. When providing pre settlement funding there is a risk the underwriter won’t get paid back if the case is lost.
The increase in settlement funding for recently settled lawsuits is an indication that insurance companies are in no hurry to pay for recently settled cases or judgments. If you are searching for commercial litigation funding chances are the defense will also delay payment for as long as they can. While the courts will mandate a time in which proceeds need to be paid, oftentimes it can take months before compensation is received.
Most people that are going through the legal processes of obtaining fair compensation for their lawsuit are unaware that it can take weeks or even months to receive compensation after a settlement. In fact, the majority of the plaintiffs currently going through the legal processes of a personal injury or commercial litigation claim believe compensation should be paid within days of winning their case. Lawsuit settlement funding can help you until compensation is paid.
If you are currently searching for a settlement funding company that can provide you an advance against your lawsuit, begin by applying online with LawLeaf.
Please note: LawLeaf can obtain settlement funding for most settled cases within 24 hours of receiving the settlement letter/offer. We have also been successful in obtaining pre settlement funding for our clients within the same time frame.
