South Carolina Toxic Mold Lawsuit
A jury in Berkeley County, South Carolina awarded $50,000 in damages and $75,000 in punitive damages against Prudential Carolina Real Estate because of a sale of a residential property without disclosing that it had a toxic mold problem.
Attorney Michael Scarafile, of Prudential Carolina told reporters that the post-trial motions have not yet been heard by trial Judge Roger Young, so the verdict has not been finalized.
There were two mold reports on the property that were not disclosed prior to the purchase of the house. Dana Winters & Daniella Winters filed a toxic mold lawsuit against Prudential Carolina and against the real estate agaent Barbara Daniels.
In 2005, the Winters bought the property for $110,000. The purchase of the property included a home along with a store. When renovations begun the Winters uncovered black mold during the renovation process. The lawsuit stated that Prudential Carolina knew about the black mold problem and failed to disclose the problem prior to selling the Winters the home.
The Winters are still paying the mortgage on the home but had to abandon the house because of the black mold problem.
According to health reports, black mold can cause serious health issues.
