Hoboken resident Ivonne Sanchez of Hoboken, New Jersey, won a $1 million settlement as a part of a drunk driving lawsuit, according to the latest news release.
Sanchez who was a victim of a drunk driving accident in 2007, was part of a hit and run. The drunk driver who was identified as Timothy Cavigliano of Linden, N.J. was alleged to have as many as 8 drinks before leaving the bar. According to reports there were over a dozen of witnesses that testified on Sanchez’s behalf. The defendant in the case, Mr. Cavigliano pleads guilty to four counts of assault with an automobile in 2007 and was later sentenced to a year of imprisonment. He was later released after only serving three months.
D’s Dugout Bar’s attorney’s disputed that the the lawsuit should be dropped because a breathalyzer wasn’t taken at the scene of the accident and Mr. Cavigliano might have been under the influence of drugs. Cavigliano maintains his innocence as he alleged he hit a garbage can and not the two women.
The accident caused catastrophic injury to Sanchez who now confined to a wheel chair and unable to speak and walk. The proceeds from the lawsuit will be used to pay off her ongoing medical expenses. The damages were awarded to the plaintiff for pain and suffering and medical bills.
