Prosecutors from Los Angeles County, California are investigating a case involving a woman facing vehicular manslaughter charges for a car accident in 2008. According to the defendant, UmniĀ  Suk Chung, the accident occurred due to a sudden acceleration. Chung told investigators that her Lexus RX 330 accelerated on its own, ultimately causing a fatal car crash. The accident occurred on Freeway 10 in West Los Angeles.

The defendant is currently facing vehicular manslaughter and reckless driving charges. The defense is arguing that the accident was a result in a defect in the automobile.

The accident occurred when Chung’s SUV reached an excess speed of over 70 MPH before crashing into a Mercedes sedan on the Overland Avenue ramp. Chung’s sister-in-law, who was a passenger in the back seat of the SUV, was killed in the crash. Chung and the other passenger were seriously injured as the result.

Over the last several months, the Toyota Motor Corp. has recalled millions of Lexus and Toyota vehicles to repair defects that could cause gas pedals to stick. The Lexus RX 330 is not currently among the recalled models. Chung’s lawyer has stated that an electronic system glitch caused the SUV to suddenly accelerate.
