Wrongful Death Case in Ohio

According to a Coroner report, Sean Levert died in jail on March 30th due to a withdraw of Xanax, an anti-anxiety drug. Today the family of Mr. Levert was in Federal Court with attorney David Malik for a wrongful death lawsuit that was filed against Cuyahoga County, Ohio Sheriff’s Department. Mr. Malik claims that the Sheriff’s department denied Mr. Levert his medication while detained and ultimately caused the sudden death of Levert.

Jail policy in Ohio states that a person must be evaluated by a doctor before they can receive prescription drugs. This policy also includes that a person can immediately receive prescription drugs in cases in which are deemed urgent. While Levert was on a list to see a doctor prior to his death, reports indicate six days had passed and Levert was not once seen by a doctor.

The next court hearing is scheduled for April of next year.
