Anthony Capozzi, a Buffalo, NY man who was wrongfully convicted and imprisoned for two Delaware Park rapes, will receive $4.25 million in a settled lawsuit against the state of New York. Mr. Capozzi who was convicted and imprisoned in 1987 spent a 22 years locked up. The settlement which was announced Wednesday was set to go to trial this summer.

A lawsuit was filed more than 2 years ago by Capozzi’s family, after Altemio Sanchez was arrested and charged with three murders. During DNA testing it was proved that Sanchez committed the rapes that Capozzi had been convicted of.  Mr. Capozzi’s attorney, Tom D’Augustino, negotiated the settlement on Mr. Cappozzi’s and his sibling’s behalf.

According to reports, Mr. Capozzi suffers from schizophrenia and is now living in a group home. The money will be used for Mr. Capozzi’s care and treatments. The money is expected to be paid out over the next month or two.
